To be subject to the Decree, you must perform road signage tasks as defined in Chapter 1, Section II, article 2, paragraph 11 of the Decree : “road signage work”: the following tasks when carried out on a public road as part of temporary works and events described in section 4.3 of chapter 4 of the manual entitled “Volume V–Road Signage”: a) the installation, operation, movement, dismantling, maintenance and maintenance of signaling and traffic management equipment; (b) the installation, operation, movement, dismantling, maintenance and maintenance of restraint devices for construction sites and other equipment used for the protection of road users or workers on site; (c) driving a protective vehicle to which an impact attenuator is attached; (d) driving a support vehicle; e) the maintenance and surveillance patrol; f) the detention patrol; (g) driving an escort vehicle; h) the work of the road signaller which consists of directing traffic on a public road with a view in particular to stopping, slowing down and controlling traffic, to protecting road users and workers on site by regulating the flow of traffic, to provide directions and traffic control signals to road users and to ensure the smooth flow of traffic. The task of applying a mark on the roadway which constitutes road signs does not constitute road signage work. However, Article 4 specifies that: This decree does not apply: 1° to employees of the Government of Canada, the Government of Quebec, a municipality, an intermunicipal board or a metropolitan community; 2° members of a police force and special constables appointed under the Police Act (chapter P-13.1); 3° to employees exclusively employed by a professional employer within the meaning of the Act respecting labor relations, vocational training and workforce management in the construction industry (chapter R-20 ); 4° to employees who carry out road signage work exclusively for their employer’s own service or needs.

This is a management right of your employer. Under the Regulation respecting the keeping of a system of registration of the Parity Committee, it is up to the employer to keep an up-to-date register which must contain the number of hours worked per day for each employee, with the precise time that the work began, was interrupted, resumed and was completed. Consequently, the employer may require that you submit time sheets. It is strongly suggested that you keep a note of the dates, times and locations for each shift you have completed.

No. There is no provision to this effect in the Decree. However, if you are a union member, a collective agreement may provide for such conditions.

No. With reference to articles 11 and 12, the hours actually worked must be paid in the same week.

Not necessarily, because article 12 of the decree provides that: Hours worked in addition to the normal working day result in an increase of 50% of the employee’s usual hourly salary, excluding bonuses, if they are required by the employer and exceed by at least two hours. the employee’s normal working day.

With reference to the article 9 of the Decree, you must be paid from the time your employer requires your presence at its offices.

Under section 3.12 of the Decree, for each 5-hour period worked, you are entitled to 30 minutes with pay for the meal period.

No. Under article 4.07 of the Decree, this is the hourly rate for Class B employees.

No. The Decree contains no such provision.

Dismissal is a definitive termination of the employment relationship. Layoff implies maintaining the employment relationship. For example, the fact of having kept the equipment during the winter season, the fact of having a return agreement the following year, etc. are elements which could demonstrate the continuity of the employment relationship. This notably affects your status as a permanent employee.

No. Employees may, however, turn to the CNESST.

Under article 15 of the Decree: For each public and non-working holiday, the employer must pay the employee compensation relating to public and non-working holidays equal to 1/20 of the salary earned during the four full weeks of pay preceding the week of the holiday, without taking into account overtime.

Article 27 of the decree provides that the balance of the health bank is payable no later than July 10 following the end of the reference period.

Under section 4.1.04 of the Decree, the contribution of $0.10/hour paid must be added to your hourly rate.

From the entry into force of the new decree, i.e. February 24, 2023.

You must have worked 300 hours in continuous service for the same employer. A maximum of eight hours of work per day counts towards reaching this 300 hours. You then become a permanent employee for this employer and you remain so until the employment relationship is terminated.

The permanent employee is entitled to sick leave and the RRSP.

The Decree provides that your employer must pay you at least: $23.00 base salary for each hour worked $0.50 premium per hour, when you perform road traffic signal tasks $0.25 premium per hour, when you are required to hold the ASP construction card Additional $0.10 per regular hour worked, for safety boots $0.10 RRSP per hour paid, when you are a permanent employee (this amount is transmitted by the employer to the CPPISRQ, which then sends it on your behalf to the Fonds de solidarité FTQ)

Article 9 of the Decree specifies that you must be paid for your travel time if: Your employer sends you to a work site located more than 40km from the employer’s place of business. You are then paid between your home and this site, on the way there and back. Your employer sends you to an assembly point located more than 40km from the employer’s place of business. You are then paid between your home and this assembly point, on the way there and back. Your employer asks you to move from one site to another site during your shift. You get paid to travel from one site to another. Your employer asks you to travel from an assembly point to a work site. You are paid to travel from the assembly point to the work site
